FOI disclosure logs

Our freedom of information (FOI) disclosure log provides access to information released in response to a request for an FOI access to documents.

PM&C publishes information released under section 11A of the Freedom of Information Act 1982 (FOI Act). Information on how to make a FOI request is available.

The disclosure log requirement does not apply to:

  • personal information about any person if publication of that information would be ‘unreasonable’
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be ‘unreasonable’
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be ‘unreasonable’
  • any information if it is not reasonably practicable to publish the information because of the extent of modifications that would need to be made to delete the information listed in the above dot points.

Deletions have been made to the documents in accordance with the exemptions available under the FOI Act.

Under the Freedom of Information Act 1982 (Cth) I seek copies of documents held by the Office for Women and/or the Department of Prime Minister and Cabinet that provide evidence that the Minister for Women was advised, by the Treasury and/or the Department of Prime Minister and Cabinet, in relation to the inclusion of gender specific (different male and female) valuation factors in the proposed Div 296 Superannuation tax changes, which lead to the systemic disadvantage of women relative to their male peers on identical incomes.

I make this request because I understand that the Government has been striving to level the playing field for women in the superannuation system. The proposed Div 296 changes include gender bias into the Tax System, to the detriment of women (relative to men) on superannuation incomes. I seek to understand whether the Treasury and/or the Department of Prime Minister and Cabinet were appropriately clear in their briefing about the proposed valuation approach to enable the Government to properly consider the options.

Specifically I am seeking:

  1. Documents showing that the Minister for Women was advised about the relative impact of the methods proposed to value annual superannuation income streams under the proposed Div 296 changes to the Australian Taxation System, on women compared to men on identical annual pensions (including but not limited to recipients of defined benefits schemes).
  2. Documents which show that the Minister for Women was provided with options to implement the valuation of annual superannuation pensions or annuities under the Div 296 changes, which would avoid introducing gender as a criteria into the tax system (for example, a set of figures to value these annuities that used a pooled (male and female combined) population instead of male and female factors.)
  3. Evidence that the Office for Women was provided with policy advice that Treasury or the Department of Prime Minister and Cabinet should have obtained from the Attorney General’s Department in relation to whether it was appropriate to use the Family Law valuation approach to calculate tax liabilities, noting this has never been done before.
  4. Evidence that the Office for Women was advised of any other aspect of the Australian Taxation System where the only factor triggering a higher effective rate of tax, is gender (and specifically that women will pay the higher rate).
