FOI disclosure logs

Our freedom of information (FOI) disclosure log provides access to information released in response to a request for an FOI access to documents.

PM&C publishes information released under section 11A of the Freedom of Information Act 1982 (FOI Act). Information on how to make a FOI request is available.

The disclosure log requirement does not apply to:

  • personal information about any person if publication of that information would be ‘unreasonable’
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be ‘unreasonable’
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be ‘unreasonable’
  • any information if it is not reasonably practicable to publish the information because of the extent of modifications that would need to be made to delete the information listed in the above dot points.

Deletions have been made to the documents in accordance with the exemptions available under the FOI Act.

  2. The documents that outline/describe the rules that the National Cabinet is bound by. To clarify further, the documents might include rules or guidance on the following issues:

  2. Whether any jurisdiction has a right of veto over decisions of the National Cabinet.
  3. Whether decisions of the National Cabinet are binding on the Commonwealth and the States/Territories.
  4. Whether the National Cabinet operates within the conventions, policies and guidance set out in the Cabinet Handbook.
  5. Whether Premiers and Chief Ministers are bound by conventions of Cabinet solidarity and confidentiality.
  6. Who is to serve as the Secretary of the National Cabinet and how the National Cabinet's decisions are recorded and disseminated.
  7. What Federal, State and Territory officials are permitted to listen to and participate in National Cabinet discussions.
  8. Whether Cabinet note-takers take note of National Cabinet deliberations.
  9. Whether deliberations of the National Cabinet (including via teleconference and videoconference) are recorded and/or transcribed, and if not, what measures are in place to ensure that National Cabinet discussions are not recorded and/or transcribed

I write seeking information under the Freedom of Information Act for copies of the official gift declarations and any photographs, for each of the gifts the prime minister received during his overseas trips to New Zealand and the United Kingdom.

Both the gifts paid for and retained by the prime minister, and those that were surrendered.

On 7 November 2019, the Office of Parliamentary Counsel sent email subject:  'FOI Consultation -  Humanitarian Overseas Service Medal Declaration [DLM=Sensitive:Legal]' to FOI@PMC.

Please provide a copy of all documents attached to this email chain in it's entirety.

On 26 November 2019, FOI@pmc replied.  The reply referred to 'PM&C reference: C19/174'.  Please provide a copy of document C19/174.

The email goes on to discuss telephone conversations between PMC and OPC.  After which FOI@pmc states “thanks for the below and for your time on the phone today. I will also let the relevant SES (Peter Rush) know of the below”.

Please provide a copy of the documents recording Mr Rush being informed.
